Falkirk, Stirling and Clackmannanshire Councils provide a range of equipment and adaptations which aim to meet the needs of people with illness or disability enabling them to remain in their own home and be as independent as possible. The Councils are looking for a qualified and experienced provider to deliver a maintenance and repair service of stair lifts, through floor lifts, platform lifts and tracking hoists across the Forth Valley area. The service must be able to ensure a responsive, high quality and reliable provision across the area which can demonstrate best value for each partner. The Service must be available across the whole Forth Valley area. The estimated volume of stairlifts and tracking hoists for the three authorities is as follows;
Falkirk Council has 475 stair lifts and 105 tracking hoists.
Stirling Council has 218 stair lifts and 22 tracking hoists.
Clackmannanshire Council has 121 stair lifts.

The value of the Service is approximately 80 000 per annum for all 3 Councils. This is an indicative figure only and no guarantee is given with regard to the overall value and uptake of any awarded agreement.
The length of the awarded agreement will be for 2 years, with the option to extend for up to a further 12 months.

Any Contract will be entered into with the nominated lead organisation and all members of the consortium, who will in these circumstances each be required to execute said Contract together with all ancillary documentation, evidencing their joint and several liability in respect of the obligations and liabilities of the Contract. It will be for members of the consortium to establish their respective duties and liabilities amongst each other.
Where partners form a sub-contracting arrangement the Council will enter into Contract with the lead organisation that will bear responsibility for the delivery of the Service required.

Precise information on deadline(s) for lodging appeals: A tenderer that suffers loss as a result of a breach of duty under the Public Contracts (Scotland) Regulations 2006 may bring proceedings in the Sheriff Court or the Court of Session. The Council will have a minimum standstill period of 10 days before awarding the contract. The communication of the award decision notice will be sent by fax or e-mail to all tenderers on day 1 of the standstill period. If proceedings are started in the Sheriff Court or the Court of Session against The Council in respect of the decision to award the contract within the standstill period then The Council is prevented from awarding the contract. Post contract award the Sheriff Court or the Court of Session may (1) award damages provided proceedings are brought within 3 months from the date when the grounds for the bringing of the proceedings first arose (2) be entitled to issue an ineffectiveness order or impose a financial penalty on The Council. A claim for an ineffectiveness order must be made within 30 days of the Contract Award Notice being published in the OJEU or within 30 days of the date those who expressed an interest in or otherwise bid for the contract were informed of the conclusion of the contract or in any other case within 6 months from the date on which the contract was entered into.
