The role of the Environmental Sustainability Institute in investigating environmental changes and the Green Campus ethos of Tremough has moulded the specifications of this cluster. Tremough Development Vehicle aims to achieve the highest possible performance with the least possible environmental impact per unit processing power along with allowing for utmost manageability, scalability and catering to a wide user base.

(1) Tremough Development Vehicle reserves the right to restrict changes to a consortium membership and a Tenderers proposed key subcontractor supply chain in accordance with requirements provided in the tender documents.
(2) In accordance with law and the terms set out in the tender documents, Tremough Development Vehicle reserves the right to change without notice any part of the proposed contract and the procedure for awarding the proposed contract, to reject all or any tenders for the proposed contract and / or stop the process or cancel the procurement at any time. Tremough Development Vehicle also reserves the right not to award a contract at any time without any liability on its part.
(3) Please also note that Tremough Development Vehicle will be able to terminate the procurement process for any reason, including but not limited to: if there are not sufficient eligible tenderers, if the grant funding application(s) relevant to the proposed contract is / are rejected, or is / are approved but with insufficient funding to allow completion of the proposed contract, or if the relevant planning approval application(s) is / are rejected, or is / are approved but with limitations or conditions that, in Tremough Development Vehicles ultimate discretion, render the supply of the services unviable. If necessary, Tremough Development Vehicle reserves a discretionary right to find alternative sources of funding.
(4) Nothing in this contract notice, tender documents, contract documents, any other written communication to the potential Tenderers / Tenderers from Tremough Development Vehicle or its representatives and any oral communication to the potential Tenderers / Tenderers from Tremough Development Vehicle or its representatives, shall generate any contractual obligations or intention to create a contract prior to any signature of a final written contract.

Tenderers should state in their Tender responses whether or not they consider the information supplied should be exempted from disclosure to third parties under the Act or the EIR and should provide reasons for such views. These views will be taken into consideration by University if Exeter and University College Falmouth when deciding whether to disclose information. B. Request to participate / tendering
(i) Simultaneous requests to participate and tendering must be made by completion and return of the Invitation to Tender by the date and time set out in section IV.3.4 of this contract notice. Failure to submit a response to the Invitation to Tender will mean that the Tenderer will progress no further in the procurement procedure for this contract opportunity.
(ii) Responses to the Invitation to Tender must be completed and submitted in accordance with the rules set out in the Invitation to Tender.
(iii) Tenderers who decide not to submit a response to the Invitation to Tender for the contract opportunity having previously expressed an interest should inform Tremough Development Vehicle of its decision not to participate in the tender opportunity by using the, correspondence, facility in the project listing in the InTend e-tendering portal (https://in-tendhost.co.uk/ universityofexeter/aspx/home.asp).

(10) Section I.4 (Type of the contracting authority and main activity or activities) – Tremough Development Vehicle is procuring under this contract notice on behalf of itself, Falmouth Exeter Plus, University of Exeter, University College Falmouth and any subsidiary company or successor bodies of these entities.
(11) All communication by potential Tenderers / Tenderers with TDV must be submitted via http://in-tendhost.co.uk/Universityofexeter/aspx/home.asp. It is anticipated that all communication with potential Tenderers / Tenderers by Tremough Development Vehicle will be via http://in-tendhost.co.uk/universityofexeter/aspx/home.asp. No approach of any kind by any potential Tenderer / Tenderer in connection with this procurement process may be made in any other manner or to any person within, or associated with, Tremough Development Vehicle (including its representatives).

(12) Environmental sustainability and equality and diversity are key objectives for Tremough Development Vehicles procurement of this contract as well for the relevant grant funding. (14) Section III.3 (Conditions specific to services contracts) – This section is not contained in this contract notice, since Tremough Development Vehicle have stated that the proposed contract is primarily a supplies contract. However, it is intended that some services may be provided as part of the proposed contract. For transparency, Tremough Development Vehicle confirm that the execution of the service is not reserved to a particular profession (Section III.3.1) and the legal entities do not need to indicate the names and professional qualifications of the staff responsible for the execution of the service (Section III.3.2) (unless otherwise requested in the Invitation to Tender).
(15) The following sections of this contract notice are not published since they are irrelevant to this procurement process being run under a procedure analogous to the Open procedure: section II.1.4 (Information on framework agreement), section IV.1.2 (Limitations on the number of operators who will be invited to tender or to participate), section IV.1.3 (Reduction of the number of operators during the negotiation or dialogue), and section IV.3.5 (Date of dispatch of invitations to tender or to participate to selected candidates).
(16) All potential Tenderers / Tenderers are solely responsible for their costs and expenses incurred in connection with the preparation and submission of responses to the Invitation to Tender and any future stages of the selection and evaluation process. Under no circumstances will Tremough Development Vehicle, Falmouth Exeter Plus, University of Exeter, University College Falmouth or any of their advisers, be liable for any costs or expenses borne by the potential Tenderer / Tenderer or any of its supply chain members or advisers in this process.
