The Contract covers all of NHH’s requirements for the provision of Building Materials – in connection with New Property Build, Property Maintenance and Property Renovation for an intial two (2) years, extendable for a further two (2) years dependant on supplier performance.

Description of particular conditions: All contract or agreements between NHH and any successful supplier will be governed solely by the NHH contract or agreement, therefore any potential supplier must be willing to accept and sign to the effect that the NHH contract or agreement is final and binding in the supply of goods under this ITT.
All prices within the agreement will be fixed for the duration of the initial two (2) year term of the agreement. If the agreement is award for a further two (2) year period, then a Consumer Price Index (CPI) increase may be invoked. Prices will then be fixed for the balance of the additional two (2) term.
NHH estimate that it’s spend on Building Materials (Electrical) over the past 12 months was 120 000,00 GBP, therefore the potential value of the contract may be up to 480 000,00 GBP if the supplier is awarded the contract for the full period of 4 years.
The need for Building Materials (Electrical) will vary over time and is difficult to estimate the potential volume of products that will be required; NHH cannot guarantee what financial amount will be spent during the term of the agreement.
The successful Supplier(s) will therefore need to have the capacity to accommodate varying demand patterns and a clear commitment to work with NHH over the full contract period to ensure maximum product availability.
NHH reserves the right to purchase from more than one supplier of Building Materials (Electrical) during the period of this agreement.
The Supplier will be responsible for managing the availability and supply of products to meet NHH requirements and ensure delivery of all orders within 24 hours of order receipt.
All products should be priced to include the charge for delivery to NHH within 24 hours without any minimum order quantity in terms of value or volume.
In the event of a supplier being awarded a contract, it is the Suppliers responsibility to ensure that there is no conflict of interest between the Supplier and NHH.
It should be noted that product quote matrix is not an exhaustive list of products that will be required, but provides an overview of the frequently used products as required by NHH.
NHH has a requirement to purchase many other types of Electrical products, therefore Suppliers should as part of their response to the ITT include the percentage discount off the standard catalogue list price for all products within the product catalogue.
Please indicate the % discount off Catalogue List Price (top of page 14) for all products not listed in the Quote Matrix on Page 14.
All products supplied to NHH must be must comply with the Electrical Equipment (Safety) Regulations 1994 and bear European Conformity (CE) marking, a CE mark is a manufacturer’s claim that its product meets specified essential safety requirements set out in relevant European directives.
All electrical equipment must be:
a. Safe – there should be minimum risk that the electrical equipment will cause death or personal injury to any person or domestic animal, or damage to property.
b. Constructed in accordance with good engineering practice in relation to safety matters.
c. Designed and constructed to ensure that it protects against electric shock through protective earthing, double insulation or equivalent.
d. Designed and constructed to conform with the principal elements of the safety objectives, which are in Schedule 3 of the regulations.

Information and formalities necessary for evaluating if the requirements are met: The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.
