VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: In accordance with regulation 47 of the Public Contrct Regulations 2006, the Council will incorporate a minimum of a 10 – calendar day standstill period starting from the date when the award decision notification is despatched to bidders. This priod allows unsuccessful bidders to seek further de-breifing from the Council before the contract is entered into. If an appeal regarding the award of the contract has not been sucessfully resolved the Public Contracts Regulations 2006 (SI 2006 no 5) povide the aggrieved parties who have been harmed, or at any risk of harm as a consequence of the breachof the procurement rules to bring action to the High Court. Any such action must be promptly and in nay event within 3 months of the date when the grounds of the complain first arose. The Court has the power to set asisde the award decision and/or the contract (if it has been entered into) and may also award damages. The purpose of the standstill period referred to above is to allow parties to apply to Court to set aside the award decision and/or the contract (if it has been entered into) or request for damages to be awarded.
