II.1.5)Short description of the contract or purchase(s)

Broxtowe Borough Council is seeking to appoint a preferred supplier to survey, manufacture, supply and install PVCu windows and external composite doors to individual council owned dwellings within the NG9 and NG16 area. Any replacements carried out must comply with current building regulations and thermal performance standards.
The successful contractor must be FENSA registered or equivalent (if relevant) and to self-certify compliance under building regulations.
It is intended to give tenants a choice of 4 styles of front door and 1 style of rear/side door with a choice of 5 colours (white, red, green, blue, black). Windows shall be in white PVCu.
There will be 3 work packages included in the tender; bidders will be invited to price these discretely.
PACKAGE 1 – Defined Works Package Phase 1 (A), includes but is not limited to:
Survey, supply and fit PVCu double glazed windows, screens, panels and patio doors plus small quantities of PVCu doors if required to council owned houses, flats and bungalows.
PACKAGE 2 – Defined Works Package Phase 1 (B), includes but is not limited to:
Survey, supply and fit composite front entrance / side doors (and frames) to council owned houses, flats and bungalows.
The successful contractor(s) will be responsible for all aspects of door, window and frame replacement including:
— The provision of competent operatives and approved materials to ensure high standards of workmanship,
— Supply and fit all components to meet current regulations in respect of Fire Safety, particularly door and frames, upgrading or replacement to flat front entrance doors and communal doors,
— Maintenance of PVCu windows within the 12 month warranty period,
— The provision of safe means of access to undertake the Works,
— Effective customer care and communications with residents and client representatives in order to ensure the smooth running of the programme of work and requisite customer satisfaction.
PACKAGE 3 – Undefined Works Package Phase 2 (C) limited to:
Undefined List (Doors Only).
The tenderer will be asked to provide a price for an undefined list of 700 properties to survey, manufacture and install new composite doors. The tenderer will allow for a front and back door for each property. Phase 2 properties are subject to budget constraints and may be added or removed at the client’s discretion.
To meet the above requirement the Council will set up a framework. The successful contractors (maximum of 4) will form the framework and be asked to quote for the provision of the expected service to the Council on an annual basis (except for year 1, where the winner of the tender process will be awarded the contract). The lowest quote will then be fixed for one year and the Contractor will provide the service under the terms and conditions of this framework for that year. The Council reserves the right to use e-Auctions for the annual RFQ process.

Precise information on deadline(s) for lodging appeals: The Council will incorporate a minimum 10 calendar-day standstill period at the point information on the award of contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the Council before the contract is entered into. Such information should be requested from the address stated in section I.1 above. If an appeal regarding the award of Contract has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 no 5) as amended by the Public Contracts (Amendments) Regulations 2009 (SI 2009 No 2992) and The Public rocurement (Miscellaneous Amendments) Regulations 2011provide for aggrieved parties who have been harmed, or are at risk of harm, by a breach of the rules, to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly. Where a Contract has not been entered into the Court may order the setting aside of the award decision or order the Council to amend any document and may award damages. If the Contract has been entered into the Court may order the ineffectiveness of a Contract where serious rule breaches have occurred in addition to any fine, the Court may instead provide for alternative penalties, either contract shortening fines or both.
