International Nuclear Services Limited (“INS”) requires:
(1) Detail design of a road vehicle comprising a powered truck and 40ft semi-trailer suitable for compatibility with 20ft ISO containers. The 20ft ISO variant container shall have a payload of highly sensitive material and will require a type approval against CSC regulations. The road vehicle configuration must be designed to satisfy all transport regulations including dangerous goods by road. The vehicle and ISO variant must be designed to satisfy use against modal regulations for sea and rail. The current intention is to use these vehicles within the UK only.
(2) Supply and manufacture of 2 (two) powered trucks, 3 (three) semi trailers and 4 (four) ISO containers, as detailed above.

III.1)Conditions relating to the contract

Payment terms will be as stated in INS’s Invitation to Tender documents.

No legal form is required but in the event of a group of contractors submitting an acceptable offer it will be necessary to provide an undertaking that each company or firm will be jointly and severally liable for the due performance fo the contract.
III.1.4)Other particular conditions

Description of particular conditions: (a) The Invitiation to Tender (ITT) will involve UK classified information at the RESTRICTED level. This will require INS to be satisfied that the information can be handled by tenderers to a level that satisfies UK regulation.
Prior to issue of the ITT Applicantswill be required to sign and return (i) a Confidentiality Agreement and (ii) a Security Aspects Letter which covers the security provision of information sent to the tenderer during the tender process. Applicants will also be required to complete a series of security questionnaires which will be iused to satisfy the security of information during the tender process and provide a guidance on compliance and how far off full compliance the Applicant may be for any resulting contract. Please confirm accepttance of this requirement.
(b) Applicants will not be considered if they do not satisfy INS that they have company wide policies and procedures which at least address the security of commercial information and assets to a standard similar to the principles of ISO 27001. Evidence of this must be provided in support of the security questionnaires referred to in (a) above.
(c) Tenderers and any sub-contractors where UK classified information will be handled during any subsequent agreement, must be willing to submit their premises and, in some cases, their employees for clearance in line with national standards. Please confirm acceptance of this requirement.
(d) Applicants based outside the UK must seek advice from their government or national security authority on either the existence of General Security Agreements orbliateral agreements with the UK government covering the security of UK classified information or national laws and regulations that may apply. Please confirm.
(e) Any agreement resulting from the ITT will be claissified in line with UK law at the UK CONFIDENTIAL level. Prior to the commencement of such agreement a formal approval will be required by either the UK Office for Nuclear Regulation or the government of the country concerned. This is the requirement for prescribed levels of physical, personal and IT security at lovcations where UK claissified information and assets at a confidential level are held, processed or generated. Where applicable please supply evidence of current or previous history of dealing with sensitive government contracts.
(f) UK based companies not already operating locations approved to either List X or List N for confidential where the agreement would be managed and operated, will be required to obtain List N approval under the sponsorship of INS. Please advise if already List X or List N or otherwise provide evidence to satisfy INS of the likelihood of a successful application.
(g) NB: It should be noted that INS will take into account the total budget costs for the project including the administration and overseeing of contractors & sub-contractors when assessing tenders.
III.2)Conditions for participation
III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: a) An independent statement proving that the applicant is not bankrupt or being wound up; that its affairs are not being administered by the court; that it has not entered into an arrangement with creditors; that it has not suspended business activities or that it is not in any analogous situation arising from a similar procedure under national laws and regulations or that it is not the subject of proceedings for a declaration of bankruptcy, for an order of compulsory wnding up or administration by the court for an arrangement with creditors, nor is it the subject of any other similar proceedings under national laws and regulations.
b) An independent statement from the appropriate authority in the country of origin in which the applicant is established to the effect that all obligations relating to the payment of social security contributions have been paid in accordance with the legal provisions of the said country.
c) An independent statement from the appropriate authorityin the country of origin in which the applicant is established to the effect that all obligations relating to the payment of taxes have been met in accordance with the legal provisions of the said country.
d) A statement from the applicant that it is willing to enter into a contract under English law.
e) A statement from the applicant that the applicant or any of its officers is not subject to criminal proceedings in any jurisdictiion.
f) A statement from the applicant that in the past 3 years it has not had a contract terminated or failed to receive contract renewal on the basis of unsatisfactory performance.
g) Applicant shall confirm that to the best of its knowledge it is not in breach of any of the provisions of Regulation 23 of the Public Contracts Regulations 2006 (as amended).

III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: Applicant shall provide audited Company and Parent Company Annual report & Financial Statements for the previous 2 years plus, if available, the latest interim results. (Where applicable similar information shall be provided for each joint venture/consortium partner).
Tenderers shall be of acceptable financial strength based on conventional company performance/liquidity ratio analysis that is appropriate for the value of the contract to be awarded, in particular that the company does not pose a high commercial risk to INS if it were awarded the contract.

Information and formalities necessary for evaluating if the requirements are met:
(1) (a) Applicant shall provide evidence that it is formally certified and/or operates in accordance with a quality system complying with ISO 9001:2008 or equivalent. Applicant shall provide copies of applicable ISO9001:2008 certificates or other quality management system certificates held. Where applicant has no formal third party certification to ISO 9001:2008 (or equivalent) but operates to formal management systems please provide details of the systems being applied for consideration.
(b) Applicant shall provide a copy of its Environment, Health and Safety policy/statement.
(c) Applicant shall provide details of its accident/incident statistics (eg TRI, DACR) performance for the last 3 years, including details of any reportable injuries, diseases and dangerous occurrences (eg under RIDDOR or international equivalent) and environmental events/statistics
(d) Applicant shall provide details of any enforcements from statutory regulators (HSE/EA etc or international equivalent) to which the applicant has been subjected within the last 3 years. If applicant has had NO enforcements this should be stated clearly in the expression of interest.
(2) NB: Should the Applicant be invited to tender INS reserves the right to seek further quality/EH&S information (eg completion of questionnaire) and may audit the Applicant against the requirements set out in the tender specification.
(3) Applicant shall provide evidence that it has:
(i) an established (1) mechanical and (2) electrical design function. Please provide an overview of your capability.
(ii) manufacturing capabilities for the following activities: fabrication and wleding, machining, electrical installation. Please provide an overview of your capability.
(iii) experience in the procurement and modification of commercial vehicles. Please state recent experience.
(iv) experience in the modification and certification of ISO freight container variations. Please state recent experience.
(v) knowledge of, and experience in the installation of ballistic protection materials. Please provide an overview of your knowledge base.
(vi) experience of designing and manufacturing manual mechanical handling systems. Please provide an overview of a system you have designed.
(vii) knowledge/experieince in the construction & approval of vehicles to meet the provisions of the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR Regulations).
(viii) ability to expedite the design, build and delivery (together with any DfT and other approvals required) of at least one powered truck, one semi trailer and two ISO containers within the timescales of 1.7.2013 to 30.9.2014. Alternatively Applicant should indicate earliest date by which delivery can be achieved.
