The Director of Finance and Corporate Services, on behalf of Renfrewshire Council, is seeking to appoint a suitably qualified and experienced agency for the provision of temporary craft (trades) workers.
The objective of the contract is to supplement staffing levels within the Building Services division to enable the employment of staff on flexible contracts as required. Supporting the Council in ensuring that property under its control is maintained and repaired to a regulatory and corporate standard by facilitating optimum, flexible staffing arrangements to meet maintenance and response times.
The contracted agency must be able to provide coverage throughout Renfrewshire, with consistent levels of service for varied assignment types and terms as required on a cost effective basis with quick response times.

None preferred, however for entering into and performing the contract, Tenderers will require to form a legal entity recognised by Scots Law. There is no preferred form of economic operator but each individual in any group is to be jointly and severally liable for the contract.
It will be for members of the consortium to sort out their respective duties and liabilities amongst each other. For administrative purposes, any associated documentation will be sent to the nominated lead organisation.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established.
(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.
III.2.2)Economic and financial ability

Information and formalities necessary for evaluating if the requirements are met: (1) All candidates will be required to provide a reference from their bank.
(2) All candidates will be required to provide a statement, covering the 3 previous financial years including the overall turnover of the candidate and the turnover in respect of the activities which are of a similar type to the subject matter of this notice.
(3) All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business.
Tenderers must evidence a good credit rating (equivalent of Equifax Rating D or above, please note that D- (minus) will not be considered as having met this criteria) and evidence an annual turnover of at least 800 000 GBP. In the event that the tenderer is not required to publish accounts and therefore does not have an Equifax or equivalent rating, the Council will conduct an analysis of the tenderers financial accounts to ensure that there is no significant financial risk.
It is recommended that candidates review their own Equifax Score Check Grade in advance of submitting their tender. If following this review Tenderers consider that the Equifax Score Check Grade does not reflect their current financial status, details of this should be provided within the Tender Submission, complete with evidence of a good high street credit rating (the equivalent of Equifax Score Check Grade D) from a recognised credit referencing agency. The Council will review any such information as part of the evaluation of Tenderer’s financial status.
In the event that a firm does not meet the financial criteria for consideration but has a parent company that does, the firm may still be eligible for consideration where their Tender Submission is supported by a Parent Company Guarantee.
In the event of a consortium bid, the collective annual turnover of the consortium will be considered in relation to the minimum annual turnover specified however the credit rating of each individual consortium member will be considered.
Tenderers must evidence the under-noted insurance provision being in place or provide confirmation that in the event of success in the tender process, the under-noted insurance provision will be put in place:
Employer’s Liability – minimum indemnity limit of 5 000 000 GBP;
Third Party /Products Liability – minimum indemnity limit of 2 000 000 GBP.

Tenderers must evidence robust health and safety policies and processes in operation. Tenderers will also be required to provide their up to date Health & Safety Policy.
Tenderers must provide a detailed and robust Quality policy or details evidence of recognised quality accreditation.
Tenderers must confirm compliance with conditions of contract or qualifications proposed must be deemed acceptable by the Council.
Tenderers must evidence ability to service the Contract by reference to work in hand, resource levels by discipline and ability to ensure availability and continuity of suitably qualified and experienced resource to undertake services required; account management arrangements; role of senior staff; management arrangements and suitable systems / technologies in place.
Tenderers must evidence relevant and appropriate experience in relation to fulfilling the requirements of the Contract by providing 2 case studies of similar work undertaken in the last 5 years.
Tenderers must provide 2 written references as part of their tender submission, which reference projects completed within the previous 2 years.
Tenderers must provide a detailed and robust complaint procedure and evidence contact details for the proposed manager together with escalation points within the organisation.
