Section II: Object of the contract
Service category No 2: Land transport services [2], including armoured car services, and courier services, except transport of mail
Main site or location of works, place of delivery or of performance: Within the county borough of Neath Port Talbot.
NUTS code UKL17
One contract will include the provision of transport for Special Educational Needs (SEN) and Social Services learners travelling to all destinations within or outside the County Borough (including schools, day centres, respite care, specific activities etc.).
A second contract will include the provision of transport for mainstream education home to school/colleges and activities transport services travelling to and from destinations within or outside the County Borough.
Community Benefits do not apply to this contract.

A second contract will comprise the provision of mainstream education home to school/college and activities transport which require a range of vehicles including buses and coaches, licensed private hire cars, private taxis and/or Passenger Carrying Vehicles.
Approximately 36 routes across the county borough will be covered by the SEN/Social Services home to school/college transport tender with a target commencement date of 11.6.2012.
Approximately 16 routes across the county borough will be covered by the mainstream education home to school/college and activities contract, with a target commencement date of 1.9.2012.

Section III: Legal, economic, financial and technical information
(b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding-up or administration by the courts or for an arrangement with creditors or is the subject of any other similar proceeding under national laws or regulations;

Section IV: Procedure
Additional information about electronic auction: There will be e-Auction events held in April 2012 comprising all services (mainstream education home to school/colleges and activities transport services, and Special Educational Needs/Social Services transport services). It is anticipated that the Auctions will be held on 10.4.2012 and 11.4.2012. Details of the specific dates for the e-Auction events will notified to tenderers during the during the e-tender process via the e-tenderwales portal.

Section VI: Complementary information
1. Register your company on the etenderwales portal (this is only required once)
— browse to the eSourcing Portal: www.etenderwales.bravosolution.co.uk,

2. Express an Interest in the Project
— login to the portal with the username/password,
— click the “ITTs Open to All Suppliers” link. (These are Invitation to Tender Questionnaires open to any registered supplier),
— click on the relevant ITT to access the content,
— click the “Express Interest” button in the “Actions” box on the left-hand side of the page,
— this will move the ITT into your “My ITTs” page. (This is a secure area reserved for your projects only),
— click on the ITT code, you can now access any attachments by clicking the “Settings and Buyer Attachments” in the “Actions” box.
3. Responding to the tender
— you can now choose to “Reply” or “Reject” (please give a reason if rejecting),
— you can now use the ‘Messages’ function to communicate with the buyer and seek any clarification,
— note the deadline for completion, then follow the onscreen instructions to complete the ITT,
— there may be a mixture of online & offline actions for you to perform (there is detailed online help available).

If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. If the contract has been entered into the Court may only award damages. [The purpose of the standstill period referred to above is to allow parties to apply to the Courts to set aside the award decision before the contract is entered into].
