Frequency and value of the contracts to be awarded: Scotland Excel gives no guarantee as to the nature or value of treatment services, the estimated value that could be awarded under the Contract will be in the range 1 250 000 GBP- 2 000 000 GBP per annum in the initial period and could increase to 12 500 000 GBP per annum in later years. This may be lower initially and may increase as Council participation increases. The value of work will be largely dependent on the waste collection service model that operates in each Council, the rate at which new services are introduced and the level of participation in the Contract as existing arrangements come to an end.

Tenders may be submitted for one or more lots
Councils in Scotland require Service Providers to receive organic waste and to treat, reprocess and recycle it. The organic waste will be collected by Councils and delivered either to the Service Provider’s treatment facility or to their designated reception point from which it will be collected by the Service Provider (s) for onward transportation for treatment.
Service Providers should provide the services in accordance with the tender documentation and the requirements of the appropriate Environment Agency and Planning Authority and in accordance with Waste Management Licences, Animal By Product Regulations, Pollution Prevention Control permits, Planning Conditions all other statutory obligations and legal permits, permission and consents which apply for such a service provision.

Description of these options: Scotland Excel reserve the right to extend this framework for up to 24 months from 1.4.2015, subject to satisfactory performance and customer satisfaction.

Section III: Legal, economic, financial and technical information
Description of particular conditions: Service Providers must be licensed, permitted or otherwise regulated by Scottish Environment Protection Agency (SEPA), who regulate and monitor the service providers. They must comply with all relevant legislative requirements in this regulated area including the data reporting of the tonnage of waste treated, recycled or otherwise disposed and the level and destination of the outputs.
(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.
(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.
(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.
(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.
(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.
(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.
(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established
(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.
All candidates will be required to provide statements of accounts or extracts from those accounts relating to their business as detailed in the tender documents.

(1) All candidates will be required to provide certification from an independent body attesting conformity to environmental management standards in accordance with the Community Eco-Management and Audit Scheme (EMAS); or the European standard BS EN ISO 14001.
(2) All candidates will be required to provide certification drawn up by an independent body attesting the compliance of the economic operator with quality assurance standards based on the relevant European standards.
(3) A statement of the principal goods sold or services provided by the supplier or the services provider in the past 3 years, detailing the dates on which the goods were sold or the services provided; the consideration received; the identity of the person to whom the goods were sold or the services were provided
(4) A check may be carried out by the contracting authority or by a competent official body of the State in which the candidate is established, to verify the technical capacity of the candidate; and if relevant, on the candidates study and research facilities and quality control measures;
(5) A statement of the candidate’s technical facilities; measures for ensuring quality; and their study and research facilities;
(6) An indication of the proportion of the contract which the services provider intends possibly to subcontract.
(7) A statement of the tools, plant or technical equipment available to the service provider or contractor for carrying out the contract.

Service Providers will work with Councils to maximize recycling opportunities and diversion rates, to meet the Requirements of The Waste (Scotland) Regulations 2012 and all of the aspects of the Zero Waste Plan for Scotland in relation to waste minimization and recycling.
Scotland Excel is required by its procedural standing orders relating to contracts to follow a process defined within those standing orders and has elected to use the ‘Open Tendering’ procedure identified therein. This provides that tender documents are made available to anyone wishing to receive them.
Scotland Excel intends to use an electronic tendering system (PCS-Tender Module) for this exercise. Interested parties can access the tender documents via this system at

Scotland Excel intends to hold 1 tenderer information session open to all interested parties to explain various aspects of the tendering process, the use of the electronic tendering system (PCS-Tender Module) and to give an general overview of the operation of the proposed framework. This session will be strictly to discuss matters of process and no discussions will be entered into regarding specific bids.
It is envisaged that the session will take place on Tuesday 29.1.2013 to allow tenderers ample time to consider the guidance provided in making their respective offers. If you are interested in attending this session please email environment@scotland-excel.org.uk confirming the name of the tenderer’s representative who will attend and a valid email address through which confirmation of the session can be sent by 12:00 on 28.1.2013.There will be no repeat of this session but information will be made available to all tenderers regardless of attendance.
Further to this session, Scotland Excel will make available a message facility through the electronic tendering system (PCS-Tender Module) which tenderers may use to ask for clarification of any points in the tender before the closing date for the messaging facility which is 12:00 on 15.2.2013. This system provides for open and transparent record of communications throughout the tender period and submitted questions will be anonymised and presented to all tenderers along with Scotland Excel’s response to ensure equal treatment of tenderers.
