II.1.5)Short description of the contract or purchase(s)

To establish a provider framework for the procuring of external learning and development to be used across the North Yorkshire County Council and that of its partners; currently Hambleton District Council and Richmondshire District Council though the framework will be open for use by other public sector organisations. It is also proposed to widen the number of organisations in the future who would be able to take up this opportunity by making the Framework Agreement available for use by other UK contracting authorities (as defined in Article 1(9) of Directive 2004/18/EC and implemented by Regulation 3 of The Public Contracts Regulations 2006) or its agent(s).
These include but are not limited to central government departments & their agencies, Non- Departmental Public Bodies (NDPBs), NHS bodies (including; acute trusts, ambulance trusts, primary care trusts, care trusts, NHS hospital trusts, strategic health authorities, mental health trusts, special health authorities), Local Authorities (as defined in Regulation 3(2) to (5) of the Public Contracts Regulations 2006 (‘the Regulations’), Police Authorities (as defined by Regulation 3 (1)(j) to (p) of the regulations), Emergency Services, Educational Establishments (including Schools, Universities, Academies, Colleges) and Registered Social Landlords who have a need to purchase these services. The Framework Agreement shall be established for a period of 3 years with the option to extend for a further period of no more than 1 further year.
Under this framework there will be 11 Lots covering different categories of training. Suppliers may bid for a single lot, multiple lots, or all lots. This process may result in more than one provider on each lot. In this instance contracts for distinct pieces of work will only arise after further competition from the each seperate framework lot. VI.4.2)Lodging of appeals

Precise information on deadline(s) for lodging appeals: North Yorkshire County Council shall in accordance with the Public Contracts (amendment) Regulations 2009, incorporate a minimum 10 day standstill period commencing at the point that information on the intention to award the contract is sent to tenderers. The Council shall, as soon as possible after the decision has been made, inform the tenderers and candidates of its decision, and shall do so by notice in writing by the most rapid means of communication practicable. The information will include; a) the criteria for the award of the contract b) the reasons for the decision c) the name of the economic operator to be awarded d) a precise statement when the standstill period is expected to end.

If an appeal regarding the award of a contract has not been successfully resolved, (for Public Sector), Public Contracts Regulations 2006 (SI2006 No 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 30 days).
Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. Following the 10 day standstill period, if no further debriefing has been requested, the court may only award damages once the contract has been entered into.
