II.2.1)Total quantity or scope:

To provide a 24/7 Distribution Service of Palletised Materials, throughout the United Kingdom (including Northern Ireland) and E.U Member States. Consignments shall be distributed by means of the selected contractor’s own distribution system or by direct, point-to-point transportation. The Contracting Authority requires an auditable real-time track and trace service capability. There are two locations, Logistic Commodities Services (LCS) Bicester and LCS Donnington, where the Contracting Authority expects significant proportions of the consignments to either be delivered to or collected from. There will be some infrequent carriage of material of a hazardous nature, including UN Classes 6 and 7. The Contracting Authority shall also require a deep frozen (-10 °C to -20 °C) and refrigerated (+2 °C to +8 °C) service capability for various palletised medical products.

The Authority reserves the right to request a Bank or Parent Company Guarantee if the supplier does not meet the required standard for economic and financial standing.

Payment will follow delivery of the service and conditions relating to financing and payment will be specified in the contract documents. The MOD has implemented an electronic purchasing system called Purchase to Payment (P2P), which is operated over the Defence Electronic Commerce Service (DECS). Any resultant contract will require the supplier to trade via the P2P system.

If a group of economic operators submits a bid, the group will be required to nominate a lead partner with whom the Authority can lawfully contract or form themselves into a single legal entity before the contract is awarded.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers

Information and formalities necessary for evaluating if the requirements are met: The Authority will apply all the offences listed in Article 45(1) of Directive 2004/18/EC (implemented as Regulation 23(1) of the Public Contract Regulations (PCR) 2006 in the UK) and all of the professional misconducts listed at Article 45(2) of Directive 2004/18/EC (see also Regulation 23(2) in the PCR 2006) to the decision of whether a Candidate is eligible to be invited to tender.

Candidates will be required to sign a declaration confirming whether they do or do not have any of the listed criteria as part of the pre-qualification process. For candidates who are registered overseas, you will need to declare if you have any offences/misconduct under your own countries laws, where these laws are equivalent to the Regulation 23 lists.
Candidates who have been convicted of any of the offences under Article 45(1) are ineligible and will not be selected to bid, unless there are overriding requirements in the general interest for doing so.
Candidates who are guilty of any of the offences, circumstances or misconduct under Article 45(2) may be excluded from being selected to bid at the discretion of the Authority.

Objective criteria for choosing the limited number of candidates: PASS/FAIL criteria shall be assessed first.
The pass/fail subjects in the PQQ will be: Grounds for Mandatory Rejection: Conviction for offences relating to Conspiracy, Involvement with serious Organised Crime, Corruption, Bribery, Fraud, Money Laundering, Terrorist Offences, Drug Trafficking or any other offence within the meaning of Article 45(1) of Directive 2004/18/EC as defined by the national law of any relevant State Submission.
Grounds for Discretionary Rejection-The Authority will ask a series of questions relating to; Bankruptcy, Insolvency Administration, Convictions of a Criminal Offence, Professional Misconduct, failure to pay Social Security and or Taxes, Misrepresentation under Regulation 23 of the Public Contracts Regulations 2006. Submission of evidence relating to Economic and Financial Standing. Failure to provide this will constitute a failure of this element of the PQQ. The Authority requires that companies hold Employers Liability Insurance of at least £5M. Failure to provide this will constitute a failure of this element of the PQQ. The Authority requires that companies hold a Goods Vehicle Operators Licence or EU equivalent, Certificate(s) of Professional Competence for Road Person(s) or EU equivalent. Failure to provide confirmation of these will constitute a failure of this element of the PQQ. Quality Accreditation: Companies or alliances must fulfil the quality accreditation requirements specified in the PQQ. In the event that they do not meet these requirements then this will constitute a failure of this element of the PQQ. Health and Safety at Work: Companies or alliances must have a Health & Safety at Work policy/process/procedure. In the event that they do not meet this requirement then this will constitute a failure of this element of the PQQ.
Interested suppliers are invited to apply for a Pre-Qualification Questionnaire (PQQ) by contacting the Authority with their Expression of Interest in response to this Contract Notice. PQQs will be issued after the advert has closed. Potential suppliers are required to send the Authority a completed PQQ providing information that allows the Authority to evaluate the supplier’s capacity and capability against the selection criteria as expanded within the PQQ. The minimum acceptable weighted score shall be detailed in the PQQ and those suppliers that pass this weighted score shall be Invited To Tender (ITT).

Please note that the requirement to which this notice relates comes under Logistic Commodities and Services (LCS), formed on 1.8.2011. LCS is determining the future strategy for all commodities and services within its remit and may in the future place a contract for the supply of services which may include the provision of articles (or services) which are covered by this notice. In this event the Authority may satisfy its requirement from the LCS service contract and no further orders will be placed against any framework arising from this notice. Alternatively, the Authority may appoint a Managing Agent to operate the framework/contract arising from this notice; novate the Agreement to a Managing Agent or third party; or assign the benefit of the Agreement to a Managing Agent. Further details will be provided in the tender documentation.
The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs).
