Information and formalities necessary for evaluating if the requirements are met: (1) The Council reserves the right to exclude a Bidder if:
(a) the Bidder has not confirmed that Blacklists are not used by or on behalf of the Bidder; and/or
(b) the Council is not satisfied that the Bidder has demonstrated that adequate measures are in place to ensure that Blacklists are not used by or on behalf of the Bidder.
(2) The Council reserves the right to exclude a Bidder if the Council is not satisfied that adequate self-cleaning has been carried out following:
(a) an adverse finding by a court or tribunal or other public body exercising similar functions regarding the use of a Blacklist by or on behalf of a Bidder;
(b) an admission by the Bidder of the use of a Blacklist by or on behalf of the Bidder.

Information and formalities necessary for evaluating if the requirements are met: In accordance with Article 47 of Directive 2004/18EC and regulation 24 of the public contracts regulations 2006 and as set out in the tender documents.
Minimum level(s) of standards possibly required: The organisation must be able to demonstrate by way of its financial resource that it represents an acceptable degree of risk appropriate for this contract.
The purpose of the Council’s assessment of an applicant’s economic and financial capability is to assess whether it canhave confidence in the applicant’s ability to perform the contract.
To this end the Council will undertake an overall assessment of information supplied as requested in the tender documents but the Council will not and does not apply specific ratios in the sense that failure to meet a specified level for one ratio would result in automatic elimination.
If one or more ratios give cause for concern an assessment will be made of any balancing factors to determine if on balance the risk of contracting with the organisation would be unacceptable.
The applicant must also be able to demonstrate the availability of financial resources appropriate to such a contract taking into account its value, duration and the level of investment required.
