This document is a qualification system notice in accordance with Article 25 of the Utilities Contract Regulations 2006 and is a request for expressions of interest for places on the Register.
Thames Water Utilities Limited wishes to establish a Qualification System (the ”Register”) that will form the basis for the award of contracts and/or framework agreements.
Organisations already working with Thames Water Utilities Limited under any other arrangement must still apply for registration to this Qualification System in order to participate in competitions for contracts and/or framework agreements falling within the scope of this Notice.
Background:
The Thames Tideway Tunnel (TTT) is a major new sewer needed to protect the River Thames from increasing pollution. The project will tackle the problem of overflows from the capital’s Victorian sewers for at least the next 100 years, and enable the UK to meet European environmental standards.

Proposed scope of work:
As part of enabling works relating to the Thames Tideway Tunnel, Thames Water Utilities Limited requires the services of one or more contractors to undertake utility protection and diversion works: The utility contractor will be responsible for civils construction (relating to utilities work), co-ordination of utility company activities, the undertaking of utility company activities where acceptable, and re-instatement. They will act as Principal Contractor, be responsible for traffic management, and for any required temporary works design. There may also be a requirement for the contractor to undertake detailed design of the protection and diversion works.

Interested applicants must contact procurement.support.centre@thameswater.co.uk to request a prequalification pack (PQQ Pack).

The PQQ Pack will serve to shortlist applicants to receive an Invitation to Tender for the initial contract.
Responses to this Notice shall comprise completed questionnaires (as contained within the PQQ Pack).
Responses may be submitted at any time during the life of this Notice. However, to be considered for the Invitation to Tender for the initial contract, completed PQQ responses must be received by 12:00 noon, 4 June 2013.
Applicants’ responses to the PQQ Pack will be evaluated (against the eligibility criteria set out in the PQQ Pack) and, providing always that there are sufficient Applicants passing Thames Water Utilities Limited’s eligibility criteria, Thames Water Utilities Limited intends to shortlist a minimum of the three highest scoring applicants and no more than 6 to receive the Invitation to Tender for the initial contract.
Other Applicants will be placed on the Register, providing that their response is evaluated as achieving a minimum acceptable standard.
Thames Water Utilities Limited intends to issue the Invitation to Tender for the initial contract on 19.8.2013.
Invitation to tenders for further packages of work may or may not be issued.
Applicants should note that this process might require references to be provided and verified, attendances at meetings, talks and presentations at no cost to Thames Water Utilities Limited.
The successful contractor(s) will be required to actively participate in the achievement of social and/or environmental objectives. Accordingly contract performance conditions may relate in particular to social, environmental or other corporate social responsibility considerations. Further details of these conditions will be set out in the ITT documents.
Any agreement resulting from this Notice may be modified to include further similar requirements at any site under the management of Thames Water Utilities Limited or its associated companies (subsidiaries, sister, parent company) within the EU.
This Notice does not preclude Thames Water Utilities Limited or its associated companies (subsidiaries, sister, parent companies etc) from issuing other contract notices for specific requirements from time to time.
Unless specifically stated otherwise, Thames Water Utilities Limited shall not be responsible for any costs, charges or expenses incurred by applicants and does not accept liability for any costs, charges or expenses incurred by applicants, irrespective of the outcome of the competition, or if the competition is cancelled or postponed.
Thames Water Utilities Limited reserves the right to terminate the competition (or part of it), to change the basis of and the procedures for the bidding process at any time, or to procure the project by alternative means if it appears that the project can be more advantageously procured by those alternative means. The most economically advantageous or any tender will not automatically be accepted.
Thames Water Utilities Limited reserves the right to procure any of the works, services or supplies referred to in this Notice separately.
Thames Water Utilities Limited reserves the right to procure repeat requirements of a similar nature without a further call for competition pursuant to Article 40(g) of the Utilities Directive 2004/17/EC.

Thatnotification will provide full information on the award decision. The standstill period, which will be for a minimumof 10 calendar days, provides time for unsuccessful tenderers to challenge the award decision before thecontract is entered into.
The Utilities Contracts Regulations (SI 2006 No 6) provide for aggrieved parties who have been harmed orare at risk of harm by a breach of the rules to take action in the High Court (England, Wales and NorthernIreland).
